1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and AloCall ("AloCall", "we", "us", "our") regarding your access to and use of our AI voice agent platform, website, and related services (collectively, the "Service").

By creating an account, booking a demo, signing a subscription, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. The service

AloCall provides customizable AI voice agents designed for tour operators, hotels, restaurants, spas, and other hospitality and travel businesses. The Service enables you to:

The Service is continuously improved. We may add, remove, or modify features at any time, provided that any material change that adversely affects a paid plan will be communicated in advance.

3. Your account

To use most features you must register an account. You agree to:

You are solely responsible for ensuring that your use of AI voice agents complies with local regulations regarding call recording, disclosure, and consumer protection. In particular, where required by law, you must disclose to callers that they are speaking with an automated agent.

5. Subscriptions & billing

The Service is offered on a subscription basis. Pricing for each plan is published on our website and applies at the time of purchase. Unless stated otherwise:

If your payment method is declined, we may suspend access until the outstanding balance is settled.

6. Cancellation & refunds

You may cancel your subscription at any time from your dashboard or by emailing us. Cancellation takes effect at the end of the current billing cycle. You will retain access to the Service until that date.

New customers benefit from a 14-day trial. If you cancel within the trial, you will not be charged. After the trial, refunds are provided only where required by applicable consumer-protection laws.

7. Your content & data

You retain full ownership of all data, scripts, recordings, and configurations you provide to the Service ("Customer Content"). You grant us a limited, worldwide, non-exclusive licence to process Customer Content solely to provide the Service and improve its performance for you.

We treat personal data in accordance with our Privacy Policy and applicable data-protection laws, including the EU General Data Protection Regulation (GDPR).

8. Intellectual property

The Service, including its software, design, logos, trademarks, documentation, and underlying models, remains the exclusive property of AloCall and its licensors. No rights are granted to you except the limited right to use the Service in accordance with these Terms.

Feedback and suggestions you provide may be used by AloCall without any obligation or compensation.

9. Service availability

We aim for high availability but do not guarantee uninterrupted access. Planned maintenance will be announced in advance where possible. Enterprise customers benefit from a formal Service Level Agreement (SLA) as defined in their contract.

10. Warranty disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that AI-generated responses will always be accurate.

11. Limitation of liability

To the maximum extent permitted by law, AloCall's total liability arising out of or in connection with the Service shall not exceed the fees paid by you during the twelve (12) months preceding the event giving rise to the claim. In no event shall we be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.

12. Termination

We may suspend or terminate your account if you materially breach these Terms, fail to pay, or engage in activity that harms the Service or other users. Upon termination, your right to use the Service ends immediately and we may delete your data after a retention period defined in our Privacy Policy.

13. Governing law

These Terms are governed by the laws of Italy, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Milan, Italy, except where mandatory consumer-protection law provides otherwise.

14. Changes to terms

We may update these Terms from time to time. Material changes will be announced via email or in-app notification at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
